1. General

1.1. This website is owned and operated by City University of Hong Kong ("CityUHK" "we" "us" "our"), a public university in Hong Kong SAR. Our registered address is Tat Chee Avenue, Kowloon, Hong Kong.
1.2. The following terms and conditions ("T&C") apply to all users of this website (https://www.cityu.edu.hk/GiftShop/). Access to and use of this website and related services are made available to you in accordance with the T&C and any other rules posted on this website.
1.3. By using this website, you agree to the T&C. Please read them carefully.
1.4. CityUHK reserves the right to make changes to this website, related policies and agreements, the Privacy Policy Statement, the Personal Information Collection Statement and the T&C at any time without prior notice and any amendment to the same are effective from the date they are published on this website. You are advised to check this website from time to time to review the update or changes to the aforesaid policies and agreements, the Privacy Policy Statement, the Personal Information Collection Statement and the T&C. By ticking the "I have read and agree to the T&C" checkbox at the checkout page and your continued access and use of our website and our services shall represent your unconditional acceptance of the latest version of the T&C.

2. Product

2.1. We endeavour to ensure that the content and the product descriptions on this website are as accurate and complete as possible. We however do not warrant that content and product descriptions are fully accurate, complete, current or error-free.
2.2. Products' photos are for reference only. There is no guarantee that the colours displayed by your computer monitor are accurate. Any minor colour difference between a product and the product's photos may be due to the lighting for photo shooting, the colour setting and resolution of display monitor or personal perception.
2.3. The packaging of the products may vary from that shown in the images of the website.
2.4. Size chart provided is for reference only.
2.5. No refund, return or exchange for any product once the order is confirmed, except for damaged, defective or faulty workmanship products.

3. Order

3.1. Once you have placed an order and completed the payment process in CityUHK Pay, a system acknowledgment email shall be sent to you for payment confirmation. This email is only a confirmation of the receipt of your order and payment and does not constitute an acceptance of your order. We will send you a follow-up email to confirm the delivery of the product ordered. This communication will be our acceptance of your order.
3.2. The availability of the product is as shown online and will be updated regularly. They should not be relied on as definite statements as to whether the product you wish to purchase are actually in stock.
3.3. We reserve our right to cancel or not to accept an order for any reasons at our sole discretion, including without limitation:
3.3.1. no sufficient stock to deliver the product you have ordered;
3.3.2. no delivery can be arranged for your area;
3.3.3. one or more of the products you ordered was listed at an incorrect price due to a human or computer error or an error in the pricing information provided by the supplier.
3.4. If we cancel or do not accept your order, we will notify you by email and will credit to your account any sum deducted by us as soon as possible. You accept that we will not be obliged to offer any compensation for disappointment suffered.

4. Pricing

4.1. Prices are shown on this website in Hong Kong Dollars (HKD). Whilst we use our best endeavors to ensure that all prices appearing on this website are accurate, we do not guarantee that they are error-free. We reserve our right to change the prices of products displayed on the website at any time, and to rectify any pricing errors that may inadvertently occur.
4.2. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming the order at the correct price or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.
4.3. If your payment account is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your payment service provider in accordance with the applicable exchange rate on the day the transaction being processed.

5. Payment

5.1. CityUHK Pay is our online payment system and it accepts payments made by Visa, MasterCard, China Union Pay, Faster Payment System (FPS), Alipay (Hong Kong and Mainland China wallet) and WeChat Pay.
5.2. By placing an order using CityUHK Pay, you confirm that the payment account(s) used is yours or that you have been authorised by the owner to use it. If your payment service provider refuses to authorise payment to this website, we will not be liable for any delay or non-delivery.

6. Violation of rules and regulations

6.1. You warrant, represent and covenant that you will not:
6.1.1. use our site for any fraudulent or unlawful purpose;
6.1.2. use any technology to attempt to disrupt any of our services in any way;
6.1.3. reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purposes, any portion of, use of, or access to this website;
6.1.4. modify, adapt, translate, reverse engineer, decompile or disassemble any portion of this website;
6.1.5. use, alter, obscure or imitate the logos or trademarks of CityUHK, or any graphics or logos reminiscent of CityUHK;
6.1.6. infringe any copyright, design right and other intellectual property rights in the product;
6.1.7. frame or mirror any part of this website without our express prior written consent;
6.1.8. create a database by systematically downloading and storing any website content;
6.1.9. advertise or send unsolicited messages of any kind;
6.1.10. impersonate others or providing any kind of false information;
6.1.11. induce, deceive, or defraud another person of goods, services, or money in any way or violate any applicable laws including but not limited to money laundering and terrorist fundraising activities.
6.2. We reserve the right to terminate your access to this website and/or cancel your order immediately at any time at our sole discretion if you are in breach of any of the T&C.

7. Intellectual property

7.1. All software and content (which is defined as, or includes, any HTML codes, text, audio or music, video, graphics, photographs, and image) are the intellectual property of CityUHK and are protected by intellectual property and copyright laws and international treaty provisions. The content is for your personal and non-commercial use only. Any unauthorised use without our prior written permission is strictly prohibited.
7.2. Any non-personal and/or commercial use of the content is only permitted when expressly authorised by CityUHK and/or its third party licensors. You may not distribute, reproduce, publish, sell or license any content contained within this website without prior consent or authorisation of CityUHK. Any such unauthorised actions may result in civil consequences or criminal penalties.

This website may include links to other websites or resources that are not operated or prepared by CityUHK. Links to other websites or resources are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked websites or resources, their operator or their content. We are not responsible for the content or accuracy of any linked websites or resources and we are not liable for any loss or damage caused or alleged to be caused by or in connection with your use of them.

9. Liability

9.1. To the greatest extent permitted by law, CityUHK does not hold legal liability for any product issues including product defects, manufacturer mistakes, dangerous product design, and failure to provide adequate warning.
9.2. You shall ensure that the purchased products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the purchased items. You acknowledge and agree that CityUHK assumes no obligation or liability for any advice or information given with the purchased products and CityUHK shall not be responsible for any inaccuracy or misstatement of any such information.
9.3. CityUHK does not guarantee that the use of this website and related services will be error-free or that this website or the servers that make it available are free of viruses or other harmful components. We recommend all users to ensure they have up-to-date software, including anti-virus, installed.
9.4. CityUHK reserves the right to withdraw or amend any item and services without notice. We will not be liable if for any reason this website is unavailable or fails to meet any obligations in the T&C at any time and for any period.

10. Indemnity and Waiver

10.1. At our request, you agree to compensate us fully and hold us, CityUHK (including its officers, directors, agents, affiliates, licensors, and suppliers), harmless from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the T&C by you.
10.2. If you breach the T&C and we take no action against you, it is no waiver for us to exercise our rights and remedies in any other situation where you breach the T&C.

11. Force Majeure

CityUHK shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of CityUHK.

12. Governing Law and Jurisdiction

The T&C shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The relevant courts of Hong Kong Special Administrative Region will have exclusive jurisdiction in the event of any dispute or claim associated with the T&C.
